Abstract

There are three components to implement a good government. First, government which make conducive law and politic environment: second, private business sector which motivate business fields and prepare occupations field; and third, society which facilitate social-politic interaction and mobilize society participation in economic, social and politic activities. To implement those components, a state caretaker must hold to people mandate and serve their interests and also hold to law supremacy for maintaining a justice and people prosperity. No one be able to implements those components except who has heart of hearts and commits on its, and also has high quality intelligence, emotional, spiritual in work ethos.

Abstract

Secara empiris, pernyataan Lord Action bahwa manusia yang memiliki kekuasaan cenderung untuk menyalahgunakannya, akan tetapi manusia yang mempunyai kekuasaan absolut sudah pasti akan menyalahgunakannya’ adalah untuk para politisi, pemburu kekuasaan, bukan untuk cendekiawan, pelaku budaya, dan kaum moralis. Cendekiawan biasanya memiliki dilemanya sendiri: terlibat dalam kegiatan budaya atau dalam politik praktis, Terkait dengan korupsi, tulisan ini akan menawarkan dua strategi sistematis yang dilakukan kaum cendekiawan dan politisi. Pertama, menggunakan kekuatan moral melalui revitalisasi mental dan keteladanan. Kedua, menerapkan kekuasaan politik dengan penegakan hukum, kebangkitan nasionalisme, peningkatan demokrasi, dan pembaharuan ekonomi.

Abstract

This article describes the relation woman and corruption, and woman’s participation to fight against the corruption. Woman can be the corruptor direct or indirectly. Woman can be a supported factor for their husbands to corrupt. Even though, like man, woman has some a capacities to fight against corruption that increases in every bureaucracy in this country. This participation is not only interpreted and focus informal area, but also in informal area. As housewife, woman can manifest this struggle by educating good moral to every member of family. A sa wife, woman can influences husbands behavior.

Abstract

This article explains the problem of corruption in general and its negative impact to society, politics, economy, and bureaucracy from Islamic economic viewpoint This article finds that corruption is a complex phenomenon. It is the outcome of the inter action between social, cultural, economic, and political factors. It cripples all aspects of social life. Corruption makes society disintegrated, politics chaotic, economy sluggish nonproductive and bureaucracy inefficient The Qur'an and The Sunnah as the primary sources of Islamic economic provide rich vocabularies, teachings and con text forbid and harm corruption. Corruption is forbidden and Allah SWT does not love corruption and has threatened the corruptible with a heavy punishment

Abstract

This paper aims to describe relation between corruption and bureaucracy in Indonesia by historical perspective. The writer explains concepts of bureaucracy, corruption, relation among bureaucracy  corruption and democracy which then the presents corruption and bureaucracy in historical perspective (comparing colonial and post freedom era in Indonesia), and opinion of the writer as a Muslim. According to the writer, corruption is not Indonesian nation's culture. The problem of corruption is related with structure of Indonesian bureaucracy softly and turns on possibility rampant of corruption, Islamic concept of construction is very anti-corruption.

Abstract

Since 1995, Indonesia has been placing itself in the big the most corrupt country. This worldly bad prestation continues in its yearly life sine. This phenomena looked as social irony, because Indonesia is religious country. Almost Indonesian are muslim. Corruption in this country is not only law phenomena, but also becomes Indonesian society culture. Almost social space was influenced by corruption viruses, in politic, bureaucracy, education area, economy even in the religion area. Moreover, corruption is not ordinary crime, but humanity crime. The corruption phenomenon are happen in global area, national, and also local area. The following article tries the Islamic law perspective against corruption.

Abstract

This research aims to: (1) classify the themes of Majelis Tarjih Muhammadiyah's decisions on woman and its gender relation issues; (2)find the contribution of Majelis Tarjih Muhammadiyah's decisions as a movement of Islamic thought reformation to gender relation issues. As a descriptive-qualitative research the subject of research is all of Majelis Tarjih's decisions. Documentation technique was used to collect primary documents which have been published by Majelis Tarjih Muhammadiyah. Sufficient of references and check recheck of subject of research were used to achieve credibility this research. The Majelis Tarjih's decisions on woman classified in three groups, Le. Putusan Tarjih (Tarjih Decisions), Fatwa fatwa Agama(Fatwas on Religion Issues), and Wacana Tarjih (Tarjih's Discourses). Gender's sensitivity of Majelis Tarjih's decisions on woman changed to constructive paradigm. The contemporary approaches of Islamic studies influenced the ijtihad methods of Majelis Tarjih. Majelis Tarjih's decisions on woman has contributed positively to Islamic thought movement on gender relation in Indonesia.

Abstract

New theology of public sphere pretends to counter secularism in modem era by breaking the separation wall of public and private affairs. It agrees with the secularization of public affairs which separates the management of public affairs of the state with that of the private affairs of religion, hut both should develop dialogue to build humanistic civilization. Islam should revitalize its legal Islamic law (fiqh) in order not to emphasize its orientation to Pillars of Islam (Rukun Islam / community sector, but try to make balance with Pillars of Belief (Rukun Iman/private sector). It will result in Pillars of Public Sector as a kind of intermingle between Rukun Islam and Rukun Iman.

Abstract

Tulisan ini memaparkan problematika dan keterbatasan jangkauan hokum pidana dalam menanggulangi korupsi, serta mencarikan solusi alternatifnya. Secara umum korupsi disebabkan oleh dua faktor utama, yaitu factor structural dan kultural. Faktor strukturalnya adalah birokrasi yang kurang kontrol dan akses publik. Sedangkan faktor kultural adalah sikap masyarakat yang seringkali menganggap wajar, atau setidaknya toleran terhadap korupsi. Namun kultur tersebut dapat dirubah dengan 'pencelaan’ masyarakat terhadap korupsi. 'Pencelaan' ini akan berdampak secara internal maupun ekstemaly sehingga nantinya bisa menjadi 'special deterrence` dan general deterrence'. Ternyata usaha pemberantasan korupsi melalui dua cara tersebut mendapatkan legitimasi dan dukungan dari Islam. Islam terbukti mengajarkan kontrol terhadap penguasa dan juga mengutuk keras korupsi.

Abstract

One of Islamic law purposes is to protect of wealth, either positive protection or negative protection. The positive preserving can be implemented by giving punishment to whom steal the other wealth, or by giving compensation to whom broke the other wealth. The negative preserving can be implemented by investing in order to improve the wealth, and to circulate the riches and also to creating social justice in the society. There is some rules and standardization in the infestation that must be considered. The rules and the standardization those of faith and moral, social and economic development, “la dhara wa la dhirara"' and balances honor and sharing of profit and lost proportionally.
